F. Jason Far-hadian Esq., Principal of Century IP Group (www.centuryip.com) maintains that protecting intellectual property in today’s video game market is necessary to establishing a distinct competitive advantage.
During my recent stay in Seoul Korea, I visited the largest underground entertainment and shopping center in Asia (the COEX Mall), where the Microsoft and Sony corporations have built spacious “game zones,” providing public access to hundreds of game stations and video games for free. Each year the center hosts international competitions where teams of players collectively compete with others online, and before the eyes of large audiences, to win multi-thousand dollar prizes.[1]
Here are a few interesting facts: total sales in the video game industry reached 7.3 billion last year;[2] sales from the online multiplayer games sector by itself is expected to grow to $763 million by 2007;[3] big business in the video game industry is coming from adults, where the average age of a game player is 30;[4] and video games have outsold movie tickets in the United States 10 to 9.[5] Not bad for a business that began as an incidental offspring of the computer software industry.
The video game industry, even though still dependent on advancements in the computer software and hardware sectors, has evolved beyond recognition in relation to its humble origins in games such as Pong and Pacman, developed 50 years ago on refrigerator size computers by timid software engineers. Modern video games have intricate storylines, bold colors and a plethora of characters and backdrops. As such, many video games today are written, designed and choreographed by writers, producers, directors and talent with experience in the arts and movie industry before a single line of code is written.
For the above reasons, the legal issues related to the protection and enforcement of rights in video game products have become more sophisticated and complex. Luckily, however, various legal means are available to help protect different aspects of a video game product, especially the functional and operational aspects, which may be protected by a patent. Alternatively, certain features may be maintained as trade secrets. Additionally, most characters, scenes, music, dialogues, story lines and source code may be protected under copyright laws as long as each contains original works of authorship.
Despite of the availability of the above legal means, there is a surprising and somewhat inexplicable lack of intellectual property protection in the video game industry. This imbalance within the video game industry is cultivating a new and relatively unexploited legal battlefield that is resulting in large judgments against infringers and licensing opportunities for those who have diligently pursued their legal right to obtain and register the respective patents and copyrights.
The 1997 case of Alpex Computer Corp. v. Nintendo Co.[6] is among the first cases involving video game patent infringement. In that case, Nintendo was ordered to pay $253 million to Alpex for infringing its patent for a machine configured to play multiple games, in contrast to the older arcade systems that could only play a single game. More recently, in March 2005, the United States Federal court in the Northern District of California found Sony guilty of patent infringement and entered a judgment ordering Sony to pay $84 million to Immersion Corp., which had a patent covering the vibration feature incorporated in the Play Station’s game controller.[7]
Accordingly, even simple operational features incorporated in a game may be worthy of patent protection. Such innovations, if properly protected, can potentially provide a distinct advantage to a game developer by way of excluding competitors from using the particular feature in their products.
In the realm of copyright protection, certain non-operational but graphical attributes or themes of a video game may be protected by preventing others from altering or modifying such attributes. For example, modding and morphing software are available that allows a player to change the look and feel of a game by adding new levels and characters or otherwise customizing the game based on the player’s preference.
The judicial consensus on whether such acts constitute copyright infringement remains unclear.[8] For example, in Microstar, Inc v. FormGen, Inc.,[9] the Court of Appeals for the 9th Circuit held that Micorstar’s act of selling a collection of additional game levels developed for the video game Duke Nukem 3D constituted “derivative work” and infringed the copyrights of the game developer FormGen. Microstar had to enjoin further sales of the product and pay $250,000 in damages. Prior to the Microstar decision, the rights to derivative work had been recognized only in literary works such as novels and films.
More recently, in January 2005, Tecmo, Inc., maker of an X-Box game (Dead or Alive Xtreme Beach Volleyball), sued the operators and users of an online bulletin board service “www.ninja-hacker.net” for posting lines of code that made the characters appear nude. The suit was dismissed in May 2005, due to a settlement between the parties. But it left unanswered the question of whether a rightful owner of a video game can legally modify the game in the same manner that a purchaser of a book can underline the text in the book.
Due partially to the ambiguities in copyright law, some video game manufacturers have relied on provisions of the Digital Millennium Copyright Act (DMCA) to target companies that distribute modding technologies. In the past, Sony, Microsoft and other companies have successfully gone after distributors of modding chips for violating the provisions of the DMCA that make it unlawful to distribute circumventing technologies such as modding software.
It is noteworthy, however, that according to a recent decision of the United States Court of Appeals for the Federal Circuit, the DMCA cannot create new copyright rights, but can only be used to enforce existing rights.[10] So it is no longer clear whether the DMCA will continue to empower video game manufacturers as it did prior to this decision.
Regardless of the above uncertainties, the noted progeny of cases confirm that courts recognize the value of intellectual property in video games and will reward the game developers that protect their rights by taking the legal steps to properly register and enforce those rights. In response to the pressing need for legal representation and specialization in the video game industry, certain intellectual property law firms such as the Century IP Group and Morrison & Foerster are further developing their resources to help their clients deal with the legal ramifications of changes in intellectual property law.[11]
In today’s competitive video game market, protection of intellectual property is not a luxury, but a necessity for success. A properly registered innovation provides a competitive advantage and further protects the owner from attack by competitors. Therefore, it would be wise for game developers and video game distributors to consult competent legal counsel about how to protect their rights and ideas so that they will have opportunities to both offensively and defensively limit competitor options.

The sport of table tennis has been encouraging new players, creating Olympic champions, and inspiring crowds of eager spectators for many many years, though few know the true history of the how the sport began, developed, and became what it is today. Below, is a brief digestible history of the sport of table tennis, that will hopefully inspire a better appreciation for it.
Though there are many variations on the initial beginnings of table tennis or ping pong, most scholars and sources concur that table tennis began in England in the late 1800s as a fun after-dinner diversion. Some rumors say it was enacted on the dinner tables themselves, while others stick to the more popular assumption that it began as a lawn and garden game, closely tied to badminton. At this time, they didn’t yet have ping pong paddles, and so English socialites used vellum bats to play. In the 1890s, Parker Brothers began work on an indoor version of the popular lawn tennis, which included the net, paddles, and ball.
In the very beginnings-though table tennis was very very popular in England-it was still looked at as solely casual, certainly not as a sport. It was not until much later-approximately 1905-1910, when table tennis/ping pong started becoming popular in other countries, such as: Japan, China, and Korea. Meanwhile, England created the first official Table Tennis Association for the purpose of finally recognizing the pastime as a sport, but it was the Asian countries who had adopted table tennis to their own national hobbies, that made it the highly competitive and respected sport it now is. These countries took on the pastime as a full-fledged sport to be mastered, and is still a highly popular sport there. Today, millions of people in these countries play; and consider table tennis a highly competitive sport to be respected and perfected.
After a brief period, England took up the sport again in the 1920s as a popular diversion. This is truly when the standardization of the game, i.e. rules, organizations, and competitions were begun. Since then, table tennis has become a popular worldwide sport, and even an Olympic event; with competitive players outnumbering 30 million worldwide and millions non-competitive. It was during this time that table tennis-through a series of adjustments-truly transformed. In 1926, the International atble tennis Federation was formed. In 1935, the three major table tennis organizations: The American Ping Pong Association, The Amateur Table Tennis Association, and the National Table Tennis Association combined to form the U.S. Table Tennis Association. In 1957, with the overwhelming worldwide popularity the once annual worldwide table tennis championships, becomes biennial. Finally, in 1988, table tennis becomes an Olympic sport at that year’s Olympics in Seoul, South Korea.
Today, the game of competitive table tennis has been preserved to almost the same rules, measurements, etc that it began with; it’s most avid competitors and the International Table Tennis Federation ensuring that the human skill and capacity for the sport is not changed with the introduction of new technology.
Table tennis has long been overlooked as a hobby or diversion, never as a sport. Even today, in some parts of the world, table tennis is still regarded as a basement family activity. With brief origins in England in the late 1800s, and then momentum from Asian countries, table tennis slowly became a more serious and competitive sport-enough so to be entered into the World Olympics in 1988 in Seoul, South Korea. Since then, it has become a worldwide competitor sport, enjoyable for both athlete and spectator; but what are the parameters of table tennis at the World Olympics? Below, I’ve discussed the most basic rules and standards of Olympics table tennis, to familiarize you with what you need before the games start up this or any year.
General Olympic Table Tennis
· In the Olympics table tennis program, there are four table tennis events: singles and doubles for men and women. There are no mixed doubles events in the Olympics; these can be found in the World Championships.
· Matches are best of five games.
· In singles, the top 16 players play in the main draw. The main draw is the elimination event for singles. The remainder 48 players enter a qualification event, in which 16 players graduate to play those in the main draw.
· The winners receive gold and silver medals, respectively. The losers receive bronze medals.
· In doubles, 32 teams are used.
· The rules for Olympic table tennis are strictly administered according to the ITTF rules.
· In both mens and womens singles competitions, there should be no more than 86 players contesting.
· This year the doubles events have been replaced with teams consisting of 3 players.
The Basic Olympic Game Details
· The equipment standards are as follows: the ball should be 40cm diameter, the net should be 15.25cm high, the table should be 9ft long x 5ft wide x 76cm high, and the court size should be rectangular and at least 14m x 7m x 5m.
· In both mens and womens singles competitions, there should be no more than 86 players contesting.
· This year the doubles events have been replaced with teams consisting of 3 players.
· The racket used must have a blade that is black on one side and red on the other to show which side is being used during competition-as each side can have different blades used.
· The table tennis ball must always be insight of all players involved.
· The free hand of the player should never touch the table during competition.
· Each player is allowed to rest a maximum period of one minute in between games.
· Each player is allowed one time out period per match of a maximum of one minute.
· Each player is allowed to towel off every six points during a match.
· An obstruction occurs when a player touches the ball-with anything-when the ball is above the playing surface and hasn’t touched the player’s side of the table.

After Jeremy Wariner won two gold medals at the 2004 Athens Olympics, sunglasses started showing up everywhere from the faces of high school track stars to those of even casual middle-aged runners. * A look at 10 of the most influential, memorable or just plain weird fashion statements made by Olympic athletes over the years.
Michael Johnson’s golden shoes
Johnson’s choice of footwear made quite a bold statement at the 1996 Atlanta Olympics. The shoes ended up matching with his medals once he won the 200-meter and 400-meter dashes.
Mark Spitz’s mustache
At a time when swimmers were busy shaving their arms and legs, Spitz showed up with a bushy mustache. He jokingly told the Russian head coach that it helped deflect water away from his face, and the following year the entire Russian team grew out facial hair.
Flo Jo’s long fingernails and track suits
They might not have been aerodynamic, but Florence Griffith-Joyner’s long fingernails stuck out like a sore thumb at the 1988 Seoul Olympics. Her track suits that resembled comic book characters helped her transform into yet another cultural oddity to come out of the ’80s.
Jeremy Wariner’s sunglasses
Wariner’s sunglasses were the means by which the runner blocked everything out on the track. Now it’s impossible to think of the two-time gold medalist without the trademark shades.
Speedo LZR suits
Next month, swimmers will show up wearing full-body swimsuits that contort their bodies and help them shave down times. The new suits are awkward enough that they require assistance to be put on, but have helped pave the way to this year’s bevy of world records.
1980s basketball shorts
Back in the 1980s, John Stockton wasn’t the only one wearing short shorts. Boy, how times have changed. These days it’s hard to find anyone under the age of 50 hooping it up in the shorts above their knees.
1968 civil rights statements
Tommie Smith and John Carlos shocked the world and reopened the debate about racism in the United States when they raised their fists at the Mexico City Olympics in 1968. Both athletes wore black socks and gloves in a symbolic and brave statement which helped further the civil rights movement.
Dave Wottle’s cap
Wottle wore the cap early in his career to keep his long hair out of his face. By the time he staged one of the biggest comebacks in Olympic history to win the 800-meter race at the 1972 Munich Olympics, the cap was just a superstitious relic.
Knee-high socks
Cuba’s Alberto Juantorena wore knee-high white socks to the 1976 and 1980 Olympics. “I guess it’s just a habit from basketball days,” Juantorena told Sports Illustrated in 1977. Juantorena and U.S. Olympian James Robinson both wore the stockings during their 800-meter runs.
Basketball leotards
Spandex is fine for gymnastics, but the Australian and Brazilian women’s basketball teams took it a step too far and wore one-piece leotards at the 2000 Sydney Games. Did somebody say “wedgie”?

Another twist on this is to ask guests to come as characters from popular films of the time. Beijing took the pride in hosting the 2008 Summer Olympics. The matter has been goodly and badly criticized by different media and people. 12 days’ one-on-one classroom study
Day 1 ~ Day 6:
Complete all the full-scale labs step-by-step together with your instructor. You will be given the best solution and detailed explanation on each lab question. Also, your instructor will show you how to avoid the easily made mistakes based on the testing experience of hundreds of our previous students.
Day 7 ~ Day 12:
You are required to go over and complete all the labs once again by yourself. Your instructor will sit next to you and provide assistance only when necessary. At the end of each date, he/she will grade and correct your configurations and summarize your daily works and give you helpful suggestions on your future exam preparations.
1 month after class support (could be upgraded to 3 months)
On the last date of your course, you will be provided with the study materials which contain the most updated full-scale labs which have not been practiced during the course. These materials reflect the latest update of the real lab exam and come with complete solutions.

Traval & Transportation
It is very convenient to travel to Guangzhou.
You can either fly into Guangzhou Baiyun International Airport (CAN) or Hong Kong International Airport (HKG). There are direct flights from the following major cities to Guangzhou every week: Europe: Frankfurt, Helsinki, Paris North America: Los Angles, San Francisco, New York, Toronto Australia: Sydney, Melbourne Asia: Tokyo, Seoul, Dubai, Singapore
Also, there are over a hundred international flights to Hong Kong. You can fly to Hong Kong first and then transfer to Guangzhou by train (duration: 2 hours and the expense is covered by CathaySchool).
Our friendly staff will meet you at the airport or train station when you arrive and then transfer you to the hotel. This is free of charge.

Students will be accommodated at the 4-star luxury hotel (President Hotel or same grade hotel), which is across the road from our training center. Each hotel room has king-size bed, air condition, internet access (free of charge), tub, flat screen television, 24-hour room service and more.
